Negotiation and Contract

If you are selling via private treaty, tender or expression of interest, you will receive offers via your agent. On Auction Day you will need to set a reserve price, this is to ensure that the property is not sold for less than a set price.

Once terms of the sale are agreed upon, the contract of sale is signed by both purchase and seller and a copy of the contract is sent to both parties’ conveyancers for further action.

Property settlement is the process of transferring property from one owner to another – it is literally when ownership of a property is handed over from the seller to the buyer. The date of settlement is specified in the contract of sale and can be a negotiated term of the contract.
As settlement day approaches, both the buyer and seller’s solicitors or conveyancers, will contact each other to ensure conditions have been fulfilled and to organise payment transfers.  Settlement day is an exciting day, and can be a busy time, so it is best to be organised. The buyer’s lender will authorise the payment for the balance of the home – this means you can expect to receive payment for the property on this date. On this day, the seller transfers the property title (handover) across to the new registered owner and the new owner takes possession of the property by way of keys being given to the new owner.  This means you’ll need to be fully moved out before settlement day to ensure the home is ready for the new owners.

Making an Offer

Putting an offer forward to the selling agent in writing avoids confusion and shows the seller than you are serious with your intent. The selling agent will notify the seller that you have made an offer and draw the Contract of Sale up for all parties to review and if terms are accepted, sign. It is a good idea to seek legal advice from conveyancer or solicitor prior to signing the contract to ensure that the terms meet your needs. Common contract conditions relate to buyer finance, due diligence and building and pest inspections.
